SaveHer Drivers User Terms and Conditions

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you") and SaveHer Drivers Pty Ltd (ACN 687 967 344) ("SaveHer Drivers," "we," "us," or "our"). By using our services or accessing our platform, you agree to comply with these Terms.

1. DEFINITIONS

  • User: Any person accessing the SaveHer Drivers platform to request or book transport services, including guardians arranging transport for minors.

  • Minor: A person under the age of 18 for whom transport may only be booked by a guardian.

  • Guardian: A parent or legal guardian authorised to book transport services for a minor.

  • Driver: An independent contractor who provides transport services through the SaveHer Drivers platform.

  • Inappropriate or Unsafe Behaviour: Includes, but is not limited to, physical violence, verbal abuse, harassment (including sexual or discriminatory), intoxication, damage to vehicles or property, unauthorised transport, and any conduct deemed unlawful or harmful.

  • Platform: SaveHer Drivers' technology systems including its mobile application, website, and manual booking support.

  • Services: The transport arrangement services provided by SaveHer Drivers.

2. CONTRACTUAL RELATIONSHIP

2.1 By accessing the platform, you accept these Terms.

2.2 We may amend these Terms by providing 30 days' notice. Continued use of the Services after notice constitutes acceptance.

2.3 These Terms may be terminated by either party at any time by written notice or by ceasing use of the Services.

3. ELIGIBILITY

3.1 Users must be:

  • Women or non-binary individuals aged 18 or over; or

  • Guardians booking rides for eligible dependents.

3.2 Users must maintain accurate registration details and not share their account.

3.3 SaveHer Drivers reserves the right to verify identity and eligibility at any time.

4. PASSENGER REQUIREMENTS AND CONDUCT

4.1 Permitted passengers include:

  • Women and non-binary individuals;

  • Female or non-binary minors;

  • Male minors under 14 (unaccompanied only until 6:00 PM);

  • Children accompanied by an eligible adult.

4.2 Passengers must comply with Australian law and act respectfully. Drivers may terminate rides due to inappropriate or unsafe behaviour.

4.3 The account holder is responsible for dependents, including communication, pickup/drop-off coordination, and ensuring readiness.

4.4 SaveHer Drivers does not provide supervision.

5. BOOKINGS & PRICING

5.1 Bookings can be made up to 14 days in advance, with a minimum of 12 hours' notice. A $2.00 pre-booking fee applies.

Cancellations:

  • 24 hours: No charge.

  • 1–24 hours: 50% of fare.

  • <1 hour or no-show: 100% of fare.

5.2 Pricing may change at any time. Users will always receive an estimate prior to booking confirmation.

5.3 Cancellation fee: $10 applies if:

  • You cancel after driver acceptance and they are en route.

  • You are more than 5 minutes late and the driver cancels.

6. PAYMENTS

6.1 Charges include base fares, distance/time rates, pre-booking and cancellation fees, and surcharges (e.g., tolls, cleaning).

6.2 Payment is processed via Stripe. Users agree to be bound by Stripe's terms and fees.

6.3 Tips are optional. A processing fee of $0.66 applies. Drivers receive 100% of tips minus Stripe fees.

7. THIRD-PARTY SERVICES

7.1 By using the platform, you agree to terms of third-party providers, including:

  • Stripe (payments);

  • Google Play and Apple App Store (platform access);

  • Twilio (communications).

8. INSURANCE AND LIABILITY

8.1 Drivers are responsible for maintaining insurance, including rideshare coverage.

8.2 SaveHer Drivers is not liable for:

  • Driver conduct or performance;

  • Vehicle condition;

  • Delays or disruptions;

  • Any loss or damage exceeding the amount paid for the relevant service.

8.3 Use of the Services is at your own risk. We provide the platform “as is."

9. PRIVACY AND DATA HANDLING

9.1 Personal information is collected in accordance with our Privacy Policy.

9.2 We may collect:

  • Name, contact, gender identity;

  • Pick-up/drop-off locations;

  • Minor's name and age (if applicable);

  • Communication and usage data.

9.3 Data related to minors is:

  • Collected solely for service delivery;

  • Not stored long-term;

  • Destroyed after service completion.

10. DEVICE AND PLATFORM USE

10.1 App and website performance may vary based on your device and network.

10.2 We are not responsible for service disruptions due to user device or internet failure.

11. INTELLECTUAL PROPERTY

11.1 All platform content, trademarks, and systems are owned by SaveHer Drivers.

11.2 You may not copy, use, or reproduce materials without written consent.

12. WEBSITE TERMS OF USE

12.1 You may only use the SaveHer Drivers website for lawful purposes.

12.2 You must not:

  • Attempt to access backend systems;

  • Commercially exploit or distribute content;

  • Misuse or reverse engineer website components.

13. DISPUTE RESOLUTION PROCESS

Step 1 – Contact Us: Email admin@saveherdrivers.com.au. We will acknowledge your complaint within 5 business days.

Step 2 – Investigation: We will respond within 30 calendar days with an outcome or update.

Step 3 – Mediation: If unresolved, we will offer third-party mediation before legal action is pursued.

Step 4 – Legal Action: You may pursue external resolution via OAIC, NCAT, or courts in NSW.

14. TERMINATION AND ACCOUNT SUSPENSION

14.1 You may stop using the platform at any time.

14.2 SaveHer Drivers may suspend or terminate your access if you:

  • Breach these Terms;

  • Engage in unlawful or unsafe behaviour;

  • Are no longer eligible under our policies or laws.

15. GOVERNING LAW

These Terms are governed by the laws of New South Wales. All disputes are subject to the jurisdiction of NSW courts.
