SaveHer Drivers Pty Ltd Independent Contractor Agreement

This SaveHer Drivers Pty Ltd Independent Contractor Agreement ("Agreement") is made between SaveHer Drivers Pty Ltd ABN 99 687 967 344 ("SaveHer Drivers Pty Ltd," "we," "our") and the driver ("you") who agrees to provide transport services through the SaveHer Drivers Pty Ltd platform.

1. Services Provided by SaveHer Drivers Pty Ltd

Once activated as a SaveHer Drivers Pty Ltd driver, we provide you access to the SaveHer Drivers Pty Ltd App ("the app"), a platform enabling:

  • Riders to request transport services from nearby SaveHer Drivers Pty Ltd drivers.

  • Drivers to view, accept, and manage ride requests.

In addition to app functionality, SaveHer Drivers Pty Ltd provides you with manual pre-booking support, communications management, and payment processing support as we scale our operations. These services collectively are referred to as "Driver Services."

Your transport service to riders is referred to as the "Passenger Service."

SaveHer Drivers Pty Ltd also requires all drivers to complete mandatory training modules prior to activation. Additional training modules may be introduced at any time. Your account may be suspended or paused if any required modules are not completed or updated within the specified time frame.

2. Your Status as a SaveHer Drivers Pty Ltd Driver

You are engaged as an independent contractor, not an employee, agent, or partner of SaveHer Drivers Pty Ltd. This means:

  • You choose your working hours.

  • You use your own vehicle and cover all related expenses.

  • You do not receive employment entitlements such as leave, superannuation, or insurance.

  • You are responsible for your own ABN, tax obligations (including GST where applicable), and any required rideshare registrations or certifications in your state.

  • You must not subcontract your account or allow any other individual to perform rides on your behalf. Your access to the platform is personal and non-transferable.

You are not exclusive to SaveHer Drivers Pty Ltd and may perform services for other rideshare or transportation platforms. However, SaveHer Drivers Pty Ltd does not guarantee any specific volume of ride requests or income levels, and you accept the inherent risks associated with variable demand and rider availability.

3. Eligibility

You may only become a SaveHer Drivers Pty Ltd driver if you:

  • Identify as a woman or non-binary person;

  • Are at least 21 years of age;

  • Hold a full unrestricted driver’s licence with a Passenger Transport Licence;

  • Pass our safety screening process including police and working with children checks;

  • Have access to a roadworthy, insured vehicle that meets our safety requirements.

You must ensure that your driver’s licence, registration, insurance, police check, and Working With Children Check remain current at all times. SaveHer Drivers Pty Ltd may deactivate your access if these requirements lapse.

SaveHer Drivers Pty Ltd’ service is exclusively offered to women, girls, and non-binary passengers, and boys up to 14 years of age. You agree to uphold this commitment as a condition of continuing to use our platform.

SaveHer Drivers Pty Ltd operates under a legally granted exemption under the Anti-Discrimination Act 1977 (NSW) permitting us to offer our service and driver opportunities exclusively to women and non-binary individuals, for the purpose of enhancing safety and social inclusion.

4. Payments

All payments are processed through Stripe. When a rider completes a payment, Stripe splits the transaction at the point of processing — allocating 80% of the fare (before GST) plus 100% of any applicable GST to your account, and 20% of the fare (before GST) to SaveHer Drivers Pty Ltd to support operations, insurance, platform maintenance, and customer support. This ensures faster, more transparent payouts and accurate GST tracking.

SaveHer Drivers Pty Ltd may deduct applicable third-party fees (e.g., Stripe, bank processing), refunds, or penalties (e.g., missed pick-ups).

We do not permit or support cash payments. All transactions must go through the platform or approved manual invoicing.

You appoint SaveHer Drivers Pty Ltd as your limited payment collection agent solely to:

  • Facilitate the Stripe transaction on your behalf;

  • Issue tax invoices to riders for the Passenger Services you provide; and

  • Receive any refunds or adjustments necessary under our policies.

5. Platform Use & Conduct

By using our app and services, you agree to:

  • Provide safe, respectful, and professional transport at all times.

  • Maintain a clean and presentable vehicle suitable for transporting women and children.

  • Report any incidents or safety concerns immediately.

  • Respect SaveHer Drivers Pty Ltd’ community standards and Code of Conduct, which includes a zero-tolerance policy for discrimination, harassment, or unsafe driving.

Drivers must report any safety concern, accident, injury, rider complaint, or legal incident to SaveHer Drivers Pty Ltd within 1 hour of becoming aware of the occurrence. Additional documentation, including police reports, witness statements, images, or relevant contact information may be requested. Cooperation with any further investigation is mandatory and may involve communication with police.

SaveHer Drivers Pty Ltd reserves the right to inspect your vehicle at any time for roadworthiness, cleanliness, and passenger safety. We may refuse or revoke approval of a vehicle at our discretion.

Your vehicle must remain smoke- and vape-free at all times. All passengers must be provided with functional seatbelts and must wear them during rides.

You must comply with NSW Point to Point Transport Regulations, including:

  • Not operating for more than 12 hours in a rolling 24-hour period;

  • Maintaining records of working hours and rest periods.

Drivers must not engage in any conduct, on or off the platform, that could bring SaveHer Drivers Pty Ltd into disrepute or negatively impact public perception. Breach of this clause may result in termination.

SaveHer Drivers Pty Ltd may collect feedback or ratings from riders regarding your conduct and service. Repeated complaints, low feedback scores, or violations of policy may result in review, suspension, or termination.

SaveHer Drivers Pty Ltd reserves the right to investigate driver conduct upon receiving complaints or concerns. Drivers agree to fully cooperate and bear the costs of any investigation, including administrative and professional services, charged at an hourly rate.

Accounts inactive for 90 consecutive days may be deactivated. Reactivation may require updated verification checks.

5A. Subcontracting and Exclusivity

You must not subcontract or delegate your services under this Agreement. Your access to the platform is personal and non-transferable. Breach of this clause constitutes immediate termination and may result in legal action. You are not exclusive to SaveHer Drivers Pty Ltd and may operate for other services.

6. Privacy and Data

We collect your personal information in accordance with our Privacy Policy. This includes:

  • Registering your driver account;

  • Managing your access to bookings;

  • Facilitating payments;

  • Ensuring passenger safety and support.

We comply with the Privacy Act 1988 (Cth) and maintain confidentiality of your personal and financial data.

7. Liability and Disclaimers

SaveHer Drivers Pty Ltd is not liable for your vehicle maintenance, insurance, or tax obligations. We do not guarantee ride volume or income levels and are not responsible for any actual or potential loss of income. You acknowledge that demand for Passenger Services may vary and accept all risks associated with such fluctuations.

You are liable for any traffic or criminal offenses incurred during rideshare services.

You agree to indemnify SaveHer Drivers Pty Ltd from any claim, loss, or liability arising from:

  • Your breach of this Agreement;

  • Misuse of the platform;

  • Violation of local laws;

  • Any employment-related claims including PAYG, payroll, or superannuation.

You must carry appropriate comprehensive car insurance with a rideshare add-on. SaveHer Drivers Pty Ltd maintains its own public liability insurance for platform-related liabilities.

8. Communications

You agree to receive essential updates about:

  • Platform changes;

  • Legal updates;

  • Safety protocols and local area alerts.

These communications are part of your continued access to SaveHer Drivers Pty Ltd and cannot be opted out of.

9. Termination

This Agreement is engaged each time you log on to the SaveHer Drivers app or accept a ride manually. Either party may terminate at any time by written notice.

SaveHer Drivers Pty Ltd may terminate:

  • With notice, for any reason;

  • Immediately, for serious breaches, including safety concerns, harassment, or criminal activity.

Suspension may occur during investigations. Suspension does not guarantee reinstatement.

10. Dispute Resolution

SaveHer Drivers Pty Ltd will acknowledge any written dispute within 7 business days and aim to resolve it within 90 days.

If unresolved, both parties must attempt mediation in accordance with NSW law before legal action. Drivers are responsible for all dispute resolution costs unless otherwise determined.

11. Governing Law

This Agreement is governed by the laws of New South Wales, Australia. Both parties submit to the non-exclusive jurisdiction of the courts in that state.

12. Entire Agreement

This Agreement (including all referenced policies) constitutes the entire agreement between you and SaveHer Drivers Pty Ltd and supersedes any previous terms or communications.

By accepting this Agreement, you acknowledge that you have read, understood, and agreed to be bound by its terms.
